Terms of Service

The agreement that governs use of the app — plans and billing, acceptable use, and what happens on downgrade, uninstall and termination.

These terms govern your use of the Marka Bundles & Upsells Shopify app (the "App"). By installing the App on a Shopify store you agree to them. If you are installing on behalf of a company, you confirm you are authorised to bind it.


1. What the App does

The App lets you build and publish bundle and upsell offers — quantity breaks, fixed bundles, mix & match, BOGO / free gift, add-on upsells and frequently bought together — and renders them on your storefront through a Shopify theme app extension. It creates and manages Shopify discounts on your behalf so those offers price correctly at checkout.

The App is a tool you operate. You decide which offers to run, at what price, and on which products. You are responsible for the commercial and legal correctness of the offers you publish, including that advertised savings are accurate and that your pricing complies with the consumer-protection and advertising rules of every market you sell into.

2. Your Shopify account

The App works only alongside an active Shopify store and is subject to Shopify's own terms. If your Shopify account is suspended or closed, the App stops working. We are not responsible for Shopify's availability, pricing or policy decisions.

You are responsible for keeping your Shopify staff accounts secure. Anyone with access to your Shopify admin can change or delete your offers.

3. Plans, billing and trials

Charges are billed through Shopify's Billing API and appear on your Shopify invoice. We never see or store your card details.

  • Every paid plan includes a 30-day free trial. You are not charged during the trial and can leave at any point before it ends at no cost.
  • Prices are shown in the App and on our App Store listing. Annual billing is charged up front and is discounted against the monthly rate.
  • Upgrades take effect immediately. Shopify pro-rates the change.
  • Downgrades take effect when you confirm them. We cancel the existing charge; Shopify handles any proration.
  • Because billing is Shopify's, refunds are governed by Shopify's refund policy. If you believe you have been charged in error, email us and we will work with you to put it right.

Nothing you have built is deleted when you downgrade. Offers beyond your new plan's limits are paused and running A/B tests are stopped with results kept. Upgrade again and republish and they return unchanged.

4. Acceptable use

You agree not to:

  • use the App to display pricing or savings claims you know to be false;
  • attempt to bypass plan limits, tamper with the billing flow, or access another merchant's data;
  • probe, scan or load-test our infrastructure without written permission (responsible security disclosures are welcome — see §9);
  • resell, sublicense or white-label the App except where your plan explicitly includes white-labelling;
  • use the App for anything unlawful in your jurisdiction or your customers'.

We may suspend an installation that is actively harming our infrastructure or other merchants. Where circumstances allow we will contact you first.

5. Availability

We aim for high availability but do not offer a contractual uptime guarantee on any plan unless separately agreed in writing. The App depends on Shopify's APIs and our hosting provider; outages in either can affect it.

Storefront rendering is designed to fail safe: if the App cannot be reached, the widget does not render and your product pages continue to work normally. No discount is applied that a shopper was not shown.

6. Your data

Our handling of data is set out in the Privacy Policy, which forms part of these terms.

In short: your offers, settings and aggregate analytics are yours. You can export your analytics from the App on plans that include export. On uninstall we delete your access token immediately and your remaining data on the schedule described in the Privacy Policy. Shopify's mandatory privacy webhooks (customers/data_request, customers/redact, shop/redact) are implemented and honoured.

7. Intellectual property

The App, its interface, and its underlying code remain ours. These terms grant you a non-exclusive, non-transferable right to use the App on stores you control, for as long as your installation is active and paid for.

Your products, brand, content and store data remain yours. We claim no rights over them and do not use them to train models or build datasets sold to third parties.

8. Warranties and liability

The App is provided "as is". To the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost sales or lost data. Our total aggregate liability for any claim arising out of or relating to the App is limited to the amount you paid us for the App in the twelve months preceding the event giving rise to the claim.

Nothing here excludes liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence.

9. Security disclosures

If you find a vulnerability, email support@houseofmarka.com with the subject line SECURITY. We will acknowledge within 24 hours. Please give us a reasonable window to fix the issue before disclosing it publicly. We will not pursue legal action over good-faith research that does not access other merchants' data, degrade service, or exfiltrate information.

10. Changes to these terms

We may update these terms. Material changes will be announced in the App or by email to the store's contact address at least 14 days before they take effect, and the "Last reviewed" date above is updated. Continuing to use the App after that date means you accept the revised terms. If you do not, you may downgrade to the Free plan or uninstall.

11. Termination

You may uninstall at any time from your Shopify admin; that ends these terms apart from clauses that by their nature survive (§§ 6, 7, 8, 12).

We may terminate an installation for material breach of §4, or if required by Shopify or by law. Where we terminate without cause we will refund any prepaid unused period.

12. Governing law

These terms are governed by the laws of India, and the courts at Gurugram, Haryana have exclusive jurisdiction, without prejudice to any mandatory consumer rights you have in your country of residence.
